The suit was brought by Apple to ensure it could go back to selling these models. A previously imposed sales ban is thus suspended for the moment. Apple will resume sales of these smartwatches as soon as possible. The Apple Watch models in question were still on sale in the U.S. through various platforms, such as Amazon and Best Buy. Patent dispute with Masimo The reason for the original sales ban on the Apple Watch models in question is Masimo’s claim against Apple for possible patent infringement. The Apple Watch Series 9 and Ultra 2 Series feature functionality that can measure oxygen levels in the wearer’s blood. Masimo accuses Apple of misappropriating the healthtech company’s technology for this purpose. Specifically, it is referring to the sensor that measures oxygen levels. In addition, Apple is allegedly luring staff away from Masimo to build that very functionality and associated sensor for the tech giant. Future developments The lawsuit between the two parties will resume on Jan. 15. However, Apple is acting swiftly and recently submitted new designs to U.S. authorities. Masimo, by the way, is said to want to make the technology available to Apple for a fee.
